SAFMA Website Terms and Conditions
South African Facilities Management Association (SAFMA)
Effective date: 26 October 2026
Last updated: 26 October 2026.
1. About These Terms
These Terms and Conditions ("Terms") govern your access to and use of the SAFMA website at www.safma.co.za, including any membership, event registration, payment, account or other online services available through the website ("Website").
By using the Website, you agree to these Terms.
Some SAFMA services, events, memberships or programmes may have additional terms. Where additional terms apply, they will be made available as part of the relevant application, registration or transaction.
Nothing in these Terms limits any rights or remedies that cannot lawfully be excluded under South African law.
2. About SAFMA
The South African Facilities Management Association ("SAFMA") is an industry association serving and supporting the facilities management profession and sector in South Africa.
The Website may provide access to:
- SAFMA membership and membership services;
- industry information and resources;
- events, conferences, workshops and roadshows;
- training and professional development;
- networking opportunities;
- publications and industry communications;
- sponsorship and partnership opportunities; and
- other SAFMA programmes and services.
3. Use of the Website
You may use the Website only for lawful purposes.
You may not:
- interfere with the proper operation or security of the Website;
- attempt to gain unauthorised access to any system, account or data;
- introduce viruses, malware or other harmful technology;
- collect personal information about others without lawful authority;
- impersonate another person or misrepresent your relationship with SAFMA;
- submit unlawful, fraudulent, misleading or infringing material; or
- use Website content or systems in a manner that unlawfully infringes SAFMA's or another person's rights.
SAFMA may restrict or suspend access where reasonably necessary to protect the Website, its users or SAFMA's systems or to address suspected unlawful activity.
South African law criminalises certain forms of unlawful access to systems, interception of data and interference with data or computer systems.
4. Membership
Membership applications and renewals submitted through the Website remain subject to SAFMA's applicable Constitution, membership requirements, policies, membership categories and fees.
Submitting an application does not automatically confer membership. Membership becomes effective once accepted by SAFMA in accordance with its applicable requirements.
Applicants and members are responsible for ensuring that the information they provide to SAFMA is accurate and current.
Where these Terms conflict with SAFMA's Constitution or another binding membership governance document in relation to membership matters, the applicable governance document will apply, subject to South African law.
5. Events, Training and Registrations
SAFMA may use the Website to administer conferences, workshops, webinars, training, roadshows, networking events and other programmes.
Specific events or programmes may have their own:
- registration requirements;
- fees;
- cancellation and refund terms;
- substitution arrangements;
- attendance requirements;
- accreditation or professional-development conditions; and
- venue or participation rules.
These will be communicated as part of the relevant registration process where applicable.
SAFMA may reasonably change an event's programme, speakers, venue, format or schedule. Where an event is cancelled, postponed or materially changed, registered participants will be informed of the applicable arrangements.
6. Fees and Online Payments
Where membership, event registrations or other SAFMA services can be purchased or paid for through the Website, the applicable price and material transaction information will be displayed or otherwise communicated before the transaction is completed.
SAFMA may use third-party payment providers to process payments. Transactions may therefore also be subject to the payment provider's applicable terms and security procedures.
A payment is subject to successful authorisation and verification by the relevant payment provider or financial institution.
Where applicable, SAFMA will make the information required for electronic consumer transactions available in accordance with South African law. ECTA requires prescribed supplier and transaction information to be made available for qualifying electronic transactions.
7. Cancellations and Refunds
Cancellation and refund conditions may differ depending on the membership, event, programme or service concerned.
Any specific cancellation or refund terms will be communicated as part of the relevant registration or transaction where applicable.
Nothing in SAFMA's cancellation or refund terms will exclude a consumer right or remedy that cannot legally be excluded under applicable South African law.
8. User Accounts
Where you create a Website or member account, you are responsible for:
- providing accurate information;
- keeping your login details confidential;
- taking reasonable steps to prevent unauthorised access; and
- notifying SAFMA if you reasonably believe that your account has been compromised.
SAFMA may temporarily suspend an account where reasonably necessary for security, fraud prevention, investigation of misuse or compliance with a legal obligation.
9. Privacy and Personal Information
SAFMA processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and other applicable South African law. POPIA establishes minimum requirements for the lawful processing of personal information.
Personal information may be collected when you apply for membership, create an account, register for an event, make a payment, subscribe to communications, complete a form or otherwise interact with SAFMA.
Full details about how SAFMA collects, uses, shares, stores and protects personal information, and how you may exercise your rights, are contained in SAFMA's Privacy Notice.
Where applicable, SAFMA's use of cookies and similar technologies is explained in its Cookie Policy.
10. Communications and Direct Marketing
SAFMA may communicate with members, event participants and other stakeholders regarding SAFMA activities and services where permitted by law.
Where consent is legally required for electronic direct marketing, SAFMA will obtain the required consent.
Recipients may opt out of SAFMA's electronic direct-marketing communications using the unsubscribe facility provided or by contacting SAFMA.
The Information Regulator has issued guidance specifically addressing direct marketing under POPIA, including unsolicited electronic communications.
11. Intellectual Property
Unless otherwise stated, Website content including SAFMA's name, logo, branding, publications, text, graphics, photographs, videos and other materials is owned by or licensed to SAFMA and is protected by applicable intellectual-property laws.
Website content may be viewed, downloaded or printed for lawful personal, professional or informational use where permitted.
Unless authorised by SAFMA or permitted by law, you may not:
- commercially reproduce or redistribute SAFMA content;
- sell SAFMA publications or resources;
- use SAFMA's name or branding in a way that falsely implies membership, accreditation, sponsorship, endorsement or affiliation;
- remove copyright or proprietary notices; or
- present SAFMA's material as your own.
Third-party trademarks and materials remain the property of their respective owners.

12. Content Submitted to SAFMA
If you voluntarily submit an article, photograph, presentation, biography, feedback or other material for publication or use by SAFMA, you retain ownership of your material unless otherwise agreed.
You grant SAFMA permission to use, reproduce, format and publish that material to the extent reasonably necessary for the purpose for which it was submitted.
You must have the necessary rights or permission to provide material submitted to SAFMA, including any third-party personal information contained in it.
13. Third-Party Websites and Services
The Website may contain links to websites or services operated by third parties.
These links are provided for convenience or information and do not necessarily mean that SAFMA endorses or controls the third party.
SAFMA is not responsible for the content, availability, privacy practices or security of third-party websites. Users should review the applicable terms and privacy policies before using those services.
14. Website Information and Availability
SAFMA takes reasonable steps to keep Website information accurate and current. However, Website content may be general in nature and may be changed or updated from time to time.
Unless specifically stated otherwise, Website content does not constitute legal, financial, engineering, occupational-health or other regulated professional advice.
Views expressed by speakers, members, contributors or third parties do not necessarily represent SAFMA's official position unless expressly stated.
SAFMA does not guarantee uninterrupted access to the Website and may temporarily suspend or modify Website functionality for maintenance, security or operational reasons.
15. Limitation of Liability
Important: This section limits certain potential claims against SAFMA. It does not exclude any right or liability that cannot lawfully be excluded.
To the maximum extent permitted by South African law, SAFMA will not be liable for indirect, incidental, special or consequential loss arising solely from the use of, or inability to use, the Website.
SAFMA is not responsible for loss caused by:
- unlawful or unauthorised use of the Website;
- inaccurate information supplied by a user;
- third-party websites or systems outside SAFMA's reasonable control; or
- circumstances beyond SAFMA's reasonable control.
Nothing in these Terms excludes or restricts any consumer right or liability that may not lawfully be excluded or restricted.
This qualification is important because South African consumer law addresses fair, just and reasonable contract terms and consumer protections.
16. Changes to These Terms
SAFMA may update these Terms from time to time to reflect changes in legislation, Website functionality, SAFMA services or operational requirements.
The latest version will be published on the Website together with the date on which it was last updated.
Where applicable law requires additional notification or consent for a particular change, SAFMA will take the required steps.
17. Governing Law
These Terms and use of the Website are governed by the laws of the Republic of South Africa.
Any dispute arising from these Terms or use of the Website will be subject to the jurisdiction of the competent South African courts, subject to any statutory right a person may have to approach another competent court, regulator, ombud or tribunal.
18. General
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Failure by SAFMA to immediately enforce a provision does not constitute a waiver of its rights.
These Terms must be read together with applicable SAFMA policies or specific terms provided in relation to a membership, event, programme or transaction.
